Media Release Agreement
Since 2019 Vancouver Poetry House has asked artists to sign a media release agreement when we share video of your performances. The agreement outlines how we will share any profit coming from the Youtube channel but more importantly, it allow artists to have control over what is shared. We are trying to simplify the use of this agreement and will be changing how we gain permission to use recordings in the near future. The agreement can be read below.
RELEASE: AGREEMENT AND AUTHORIZATION
FOR USE OF AUDIO AND VIDEO MATERIAL IN MEDIA
The release is between the poet(name) and Vancouver Poetry House. It regards the performance on (date) of the poem(s) (titles) that are about (topic).
BACKGROUND:
The Society creates media, which includes :
filming, film/video editing, and film/video production; television production; documentary production and editing; collecting audio for podcasting; and web design and production.
The Poet consents to being a subject of the Society in media. The Poet will allow the Society to capture images and sound recordings for use in media.
WHEREBY:
THE SOCIETY IS RELEASED OF LIABILITY: For good and valuable consideration herein acknowledged as received, the Poet releases the Society and assigns permission to license all images and sound recordings and to use of images and sound recordings in any media for any purpose which may include, among others, advertising, promotion, marketing and packaging for any product or service of the Society. The Poet agrees that any images and sound recordings may be combined with other images, text and graphic, cropped, altered and modified.
THE SOCIETY RETAINS ALL RIGHTS: The Poet agrees that the Society has all rights to images and sound recordings for perpetuity unless explicitly noted in this Agreement.
Any revenues generated with the use of the video on social media will be split in the following manner:
- The first $100 generated will go in its entirety to the Society.
- The second $100 generated will go in its entirety to the Poet.
- Any further revenue generated will be split equally between the Society and the Poet.
The Poet acknowledges and agrees that the Society is not liable for any further consideration or accounting, and further claims for any reason.
DURATION OF AGREEMENT: The Poet acknowledges and agrees that this Agreement is binding on all heirs and assigns. The Poet acknowledges and agrees that this Agreement is irrevocable, worldwide and perpetual.
This Agreement contains the entire agreement between the parties to this release and the terms of this Agreement are contractual and not a mere recital.
This Agreement will be construed in accordance with and governed by the laws of the Province of British Columbia.
